We ship by sea, air and land throughout Europe by express courier GLS.

Shipping costs for European countries are calculated according to the volume of the item.

Delivery time

The delivery of the goods takes place within the Italian territory within 10 days from the receipt of the online payment through Paypal, credit card or bank transfer. Weekends and holidays are not to be considered when calculating delivery times. The times indicated as delivery terms cannot be considered binding for Monalfungo and must be considered as a reference and not a constraint. Delivery times to foreign countries depend on the destination. In case of changes or delays in delivery, the customer will be notified immediately. Delivery times refer to the products in stock at the time of order.

Shipping costs and VAT.

Shipping costs are calculated based on the amount of the order. 

The shipping price for shipments abroad is calculated based on the weight of the products ordered and the country of destination. 

All sales prices of the products displayed and indicated on the Monalfungo website are inclusive of VAT and all other taxes. The cost of transport is duly indicated on the website, and the customer has to take note of it before confirming the purchase. In case of delivery abroad, any additional costs due to taxes or duties provided for by the legislation in force in the country of destination as well as any other surcharges will be charged to the customer.

Purchase contract

The purchase contract is finalized by correctly filling in the form and the consent to the purchase, which is given online. The customer can pay for the goods ordered through the payment methods indicated online at the time of purchase. The prices of the products are indicated on the Monalfungo website, which might update its prices, and the delivery is always subject to the availability of the products. The prices do not include any installation costs and other supplies of services or materials related to the object of the contract and/or the type of product.

How to order

By sending the order form the customer receives an order confirmation by e-mail.

The order confirmation has the sole purpose of notifying the receipt of the electronic order.

Some offers or items may be out of stock in the meantime or have undergone changes in features or price. In this case, we reserve the right to contact you as soon as possible in order to cancel your order (without penalty for both parties) and possibly offer you an alternative product or price. 

Acceptance of the conditions of sale

Each product order transmitted to Monalfungo constitutes a contractual proposal and, therefore, will be binding for Monalfungo only if confirmed for acceptance. 

The execution of the order is equivalent to confirmation and acceptance of the same. Monalfungo has the right to refuse the customer’s purchase proposals. In this case the customer will not be entitled to any refund or compensation whatsoever. The fiscal documentation relating to the products ordered will be issued by Monalfungo when the products are shipped to the customer. If the customer holds a VAT number and wishes to receive an invoice in his name, he must indicate this request in the order.

Obligations of the purchaser

Upon delivery of the goods by the courier, it will be the customer’s obligation, under penalty of forfeiture of any right or objection, to verify: a) that the number of packages delivered corresponds to what is indicated in the transport document; b) that the product indicated on the packaging corresponds to what is actually indicated on the invoice; c) that the packaging is intact, not damaged or wet or otherwise altered.

Any damage or mistake in the number of packages or indications must be immediately reported to the courier who carries out the delivery.

In case of absence of the recipient at the time of delivery, the courier will leave a notice and the customer must personally contact the courier as soon as possible in order to agree on the method of delivery.

It is strictly forbidden for the purchaser to enter false and/or fictional data in the registration procedure and in the related further communications. It is strictly forbidden to make double registrations corresponding to a single person or enter data of third parties. Monalfungo reserves the right to legally prosecute any violation and abuse, in the interest and for the protection of all its customers.

It will be the customer’s obligation to keep the purchase invoice; without it, the customer will not be able to take advantage of the warranty on the product.

Returning a product

If there is a problem with the product purchased, please report it immediately to the Monalfungo Customer Service by calling within 48 hours of receipt of goods to +39 0141 669300.

It is possible to obtain a replacement or refund of the goods in case they arrive damaged for transport, provided the delivery receipt was signed “subject to inspection” when the customer received the package.

Monalfungo recommends all its customers to ask the courier to sign “subject to inspection” upon receipt of the goods.

This way, you reserve the right to check the integrity of the product afterwards, and you will be able to claim and obtain a refund or replacement of the goods in case of transport damage.

Right of withdrawal

The consumer has the right, within a period of 10 working days from receipt of the goods, to exercise the right of withdrawal, which consists in the right to return the purchased goods to the seller, and the consequent right to a refund of the purchase price.

When the stipulation of a contract is made outside the business premises, the sale in question is to be considered subject to Legislative Decree no. 50 of 15/01/1992 and subsequent amendments (see Consumer Code), which allows the buyer to exercise the right of withdrawal provided that the goods to be replaced are intact. Such kind of purchase corresponds to purchases made by telephone, or via the Internet, whether delivered at home or collected at the company’s headquarters or at a point of presence in the territory. This right applies to natural people acting for purposes that can be considered unrelated to their business activity. Therefore, purchases made by retailers and companies are excluded from the right of withdrawal.

This right applies to the product purchased in its entirety and integrity:

1) you cannot exercise withdrawal only on part of the product purchased; 

2) the right does not apply to products once opened; 

3) the purchased product must be intact and returned in its original packaging, complete in all its parts; 

4) according to the law, shipping costs are charged to the customer; 

5) the return shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; 

6) in case of damage to the goods during transport, Monalfungo will inform the customer of the incident (within the working day following receipt of the goods in its warehouse), to enable him to file a complaint against the courier and obtain reimbursement of the value of the goods (if insured). In this case, the product will be returned, with shipping costs borne by the customer. The request for withdrawal will be cancelled;

7) Monalfungo is not liable in any way for damage or theft/loss of goods returned by uninsured shipments. Upon arrival at the warehouse, the product will be examined to assess any damage not resulting from transport. If the original internal/external packaging is damaged, Monalfungo will deduct 20% from the refund due as a contribution to the costs of restoration of the goods. Apart from any repair costs for damages to the original packaging, Monalfungo will refund the customer the entire amount already paid, excluding shipping costs, within 30 days from the date of return of the goods. It will be the customer’s responsibility to promptly provide the bank details on which to obtain the transfer.

Content of the declaration of withdrawal

Make sure you have the following data ready: 

(a) original purchase document (invoice number and date); 

1. b) bank details on which to obtain the transfer (ABI – CAB – Current Account of the invoice holder). 

If the invoice holder does not have his own bank details, he can provide those of a family member or acquaintance by explicitly authorizing Monalfungo to credit the amount on this bank account. Subsequently, he has to send a registered letter with acknowledgement of receipt stating his will to exercise the right of withdrawal and summarizing all the above mentioned and requested data (including any authorization to credit the amount to a bank account in the name of a third party). Afterwards it will be the customer’s responsibility to carefully pack the products in order to safeguard the original packaging of the products from any damage and send them to the address: Monalfungo – Regione Barbone 7 14013 Monale d’Asti. The customer will be responsible for the return shipping charges. 

The communication containing the right of withdrawal may be sent, within ten working days of receipt of the product, also by telegram, e-mail or fax provided that it is confirmed by registered letter with acknowledgment of receipt within the next forty-eight hours. In order to exercise the right of withdrawal and any other communication to Monalfungo, the customer must use the following addresses: Monalfungo – Regione Barbone 7 14013 Monale d’Asti. – Email address info@monalfungo.

Communication of withdrawal

If the above procedure is carried out correctly, after having verified the integrity of the returned goods Monalfungo will credit the customer within 30 working days of receipt of the goods with the amount paid in the invoice, excluding shipping costs which will be borne by the customer.

Forfeiture of the right of withdrawal

The right of withdrawal is totally forfeited if the goods (packaging and/or content) are not intact. 

In case of forfeiture of the right of withdrawal, Monalfungo will return the purchased goods to the sender, charging him the shipping costs. Monalfungo has the right to terminate the contract by simply notifying the customer with adequate and justified reasons. In this case the customer will only be entitled to a refund of any amount already paid.

It is understood that the consumer forfeits his rights if he does not report the lack of conformity within two months from the date on which he discovered the defect. In order for the warranty to be operative, the warranty certificate must be kept together with the delivery document valid for tax purposes (delivery note, invoice, tax receipt, other documents) indicating the delivery date, the identification details of the product and the price. In case of need, both documents must be shown.

Failure by the customer to comply with only one of the customer’s obligations will result in the termination of the contract pursuant to art.1456 of the Italian Civil Code, without need for a judicial decision, without prejudice to Monalfungo’s right to take legal action for compensation for further damages.

Personal data

Monalfungo guarantees that the data relating to your person, orders and purchases made will be treated lawfully and correctly, in full protection of the rights and confidentiality of the customer. Monalfungo undertakes not to spread or sell the information in its possession to external companies: the data will be used for the sole purpose of selling and shipping the products. 

Only with the customer’s consent, the data may also be processed for the purpose of providing information on our news, initiatives and promotional offers. In accordance with Law 675/96 (Privacy Law) and subsequent amendments, we inform you that your personal data are processed for commercial purposes of direct sales, promotional, management, statistics and credit protection.

As a registered user, the customer has the right to ask for confirmation of the existence of his personal data at Monalfungo in order to know their origin, logic and purpose of their treatment; to obtain their updating, rectification or integration; to ask for their cancellation, transformation into anonymous form or blocking in case of unlawful processing; to oppose their treatment for legitimate reasons. Force Majeure

Monalfungo is not responsible for inefficiencies due to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, the execution of the contract in the agreed time. Monalfungo will not be liable to any party for damages, losses and costs incurred as a result of the non-performance of the contract, as the consumer is only entitled to a refund of the price paid if Monalfungo’s responsibility is proven. 

Limitations of liability

Monalfungo is not responsible for any fraudulent and illegal use that may be made by third parties of credit cards, checks and other means of payment used at the time of payment for the products purchased. In fact, during the purchase procedure Monalfungo is not able to know the buyer’s credit card number, which is transmitted directly to the bank managing the service. Likewise, Monalfungo is not able to check the correct and lawful origin of any credit card that is delivered by the customer upon receipt of the goods.

In any case, the relevant regulations and application of the product warranty are those indicated and highlighted by the manufacturer of the goods sold in his certificate attached to the product. Reference should be made, where necessary, to the specific information on the subject specified the Consumer Code introduced by Legislative Decree no. 206 of 6 September 2006.

Jurisdiction and applicable law

Any dispute relating to the application, execution, interpretation and breach of purchase contracts entered into “on line” through this site is subject to Italian jurisdiction. For any dispute between the parties regarding this contract, the Court in whose district the consumer has his domicile (if located in Italy) will have jurisdiction; for all other customers any dispute will be dealt with in the Court of Asti.
